These terms and conditions ("Terms") apply to your use of www.board-worx.com (the "Website") and to purchases made from us through the Website. Please read them carefully before placing an order.
By placing an order, you are offering to purchase goods from us on these Terms. Nothing in these Terms affects any rights you have under UK consumer law.
We may update these Terms from time to time. The version in force when you place your order will apply to that order.

In these Terms, "we", "us" and "our" mean Board-Worx / Whitstable Windsurfing Limited. "You" and "your" mean the person placing the order.
2. Our products
We sell new, used, ex-demo and second-hand watersports equipment, clothing and accessories.
We take reasonable care to ensure that product descriptions, specifications, photographs and prices shown on the Website are accurate. Product images are for illustration and minor variations may occur, including variations in colour caused by screens, photography or manufacturing changes.
Where an item is used, ex-demo or second-hand, we will describe its condition on the relevant product page. Reasonable signs of use consistent with that description should be expected. This does not affect your statutory rights if an item is faulty, not as described or otherwise fails to meet the requirements of consumer law.
All products are subject to availability. We may change or withdraw products from sale at any time before a contract with you has been formed.
3. Prices and payment
All prices on the Website are shown in pounds sterling (GBP) and include VAT where applicable. Delivery charges, where applicable, are shown separately at checkout.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before your order has been accepted, we will contact you and give you the option of proceeding at the correct price or cancelling the order.
We are not obliged to supply goods at a price that is clearly incorrect where the error could reasonably have been recognised as a mistake.
Payment is taken through the payment methods and payment providers offered at checkout. We do not store your full payment-card details.
4. Your order and when a contract is formed
When you place an order, you are making an offer to buy the goods shown in that order.
We will normally send an automatic order acknowledgement by email. This confirms that we have received your order, but it does not mean that we have accepted it.
A binding contract between you and us is formed when we dispatch the goods and send you confirmation of dispatch. For collection-only orders, the contract is formed when we confirm that the goods are ready for collection.
Before a contract is formed, we may decline or cancel an order, including where goods are unavailable, there is an obvious pricing or description error, we are unable to obtain payment authorisation, or we reasonably suspect fraud or misuse of the Website.
If we cancel an order after taking payment but before a contract is formed, we will refund the amount paid.
5. Delivery and collection
- We deliver across the UK where delivery is available for the relevant product and destination. Free delivery applies to most UK mainland orders over £50. Smaller orders are charged from £3.50, as shown at checkout.
- Some locations, including certain Scottish Highlands, islands and BT postcodes, and some oversized items, may be excluded from standard free-delivery arrangements. The applicable charge will be shown at checkout or advised before the order is accepted.
- We do not currently offer general overseas shipping.
- Some large or specified products, including certain boards and kayaks, may be collection only from our Whitstable store. This will be stated on the product page.
Any delivery date or timescale shown on the Website or given by us is an estimate unless we expressly agree a specific delivery deadline with you.
Where no different delivery period has been agreed, we will deliver the goods without undue delay and normally within 30 days after the contract is formed, as required by law.
If delivery is delayed by circumstances outside our reasonable control, we will contact you as soon as reasonably possible. Nothing in these Terms affects any statutory rights you may have if goods are not delivered within an agreed time or within the period required by law.
Risk in the goods passes to you when the goods are delivered into your physical possession, or into the physical possession of a person you identify to receive them on your behalf. For collection orders, risk passes to you when you collect the goods.
If your order arrives damaged, or has not arrived within a reasonable time after you receive a dispatch confirmation, please contact us promptly so that we can investigate and put matters right.
6. Your right to cancel an online order
If you are a consumer buying online, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 normally give you the right to cancel your order without giving a reason.
The cancellation period normally ends 14 days after the day on which you, or a person nominated by you, receives the goods.
If an order contains multiple goods delivered on different days, the cancellation period normally runs from receipt of the last item.
To exercise your right to cancel, you must tell us clearly that you wish to cancel before the cancellation period expires.
You can do this by emailing info@board-worx.com, contacting us using the details above, or using the model cancellation form at the end of these Terms. You do not have to use the model form.
Returning goods after cancellation
If you cancel under your statutory cancellation right, you must send or bring the goods back to us without undue delay and no later than 14 days after telling us that you wish to cancel.
Unless the goods are faulty, incorrect or otherwise supplied in breach of contract, you are responsible for the direct cost of returning them to us.
You may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning, broadly as you would be able to do in a shop.
We may reduce your refund to reflect any reduction in the value of the goods caused by handling beyond what is reasonably necessary for that purpose.
Where possible, please return goods with their original packaging, labels, accessories and documentation. Your statutory cancellation rights are not automatically lost merely because packaging has been opened, except where a legal cancellation exception applies.
Refunds following cancellation
If you validly cancel your order, we will refund payments due to you without undue delay and no later than 14 days after:
- the day we receive the goods back; or
- if earlier, the day you provide evidence that you have sent the goods back.
Where applicable, the refund will include the price paid for the goods and the cost of our least expensive standard delivery service.
If you chose a more expensive or enhanced delivery option, such as express delivery, we are not required to refund the additional amount above our standard delivery charge.
Refunds will normally be made using the same payment method that you used for the original transaction, unless you expressly agree otherwise.
Exceptions to the cancellation right
The statutory right to cancel does not apply in certain circumstances permitted by law. Examples may include:
- goods made to your specifications or clearly personalised;
- sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed, where the legal requirements for that exception are met;
- other goods or contracts specifically excluded from the statutory cancellation right.
Where an exception is relevant to a particular product, we will make this clear where reasonably possible before you order.
7. Incorrect, missing or damaged items
If we send you an incorrect item, your order is incomplete, or goods arrive damaged, please contact us as soon as reasonably possible.
Where the problem is our responsibility, we will put it right in accordance with your legal rights. This may include arranging and paying reasonable return costs and, depending on the circumstances, supplying the correct goods, replacing damaged goods or providing a refund.
8. Faulty goods and your statutory rights
Goods supplied by us must be of satisfactory quality, fit for any purpose made known to us where the law requires, and match their description.
If you believe an item is faulty, please contact us with proof of purchase, such as your receipt or order confirmation. We may need to inspect or test the item to determine the nature and cause of the problem.
Your statutory rights are not limited by any manufacturer's warranty or guarantee. A manufacturer's warranty or guarantee may provide additional rights, but it does not replace your rights against us as the retailer.
Under the Consumer Rights Act 2015, depending on the circumstances, your remedies may include:
- a short-term right to reject qualifying faulty goods and receive a refund, normally within the first 30 days;
- a repair or replacement;
- a price reduction; or
- a final right to reject the goods and receive a refund where the legal conditions are met.
The remedy that applies will depend on matters such as when the fault arose, the nature of the fault, whether repair or replacement is possible, and whether a previous repair or replacement has resolved the problem.
Where the law requires us to bear the cost of returning faulty goods, or the reasonable costs associated with repair or replacement, we will do so.
We may offer store credit as an alternative where you agree to accept it, but store credit will not replace any statutory right you have to a monetary refund.
Nothing in these Terms excludes or restricts your statutory rights.
9. Used, ex-demo and second-hand goods
Used, ex-demo and second-hand items are sold in the condition described on the relevant product page. Reasonable wear, cosmetic marks or signs of use that have been accurately disclosed are part of the description of the goods.
Your statutory rights still apply. The goods must match their description and meet the standards required by consumer law, taking into account matters that may legitimately be relevant such as their age, price and disclosed condition.
If you buy a used, ex-demo or second-hand item online as a consumer, your statutory 14-day cancellation right will also normally apply unless a legal exception applies.
10. Safe use of watersports products
Watersports can involve inherent risks. You are responsible for using products appropriately, following relevant manufacturer instructions and warnings, checking equipment before use, and using equipment within your ability and in conditions appropriate to your experience.
Where appropriate, you should obtain suitable professional instruction, wear appropriate safety equipment and follow applicable local rules, laws and guidance.
We are not responsible for loss or damage caused by misuse of a product, failure to follow instructions or warnings, unauthorised modification, abnormal use, or ordinary wear and tear, to the extent that the loss or damage was caused by those matters.
This section does not exclude or restrict any responsibility that we have under law for defective, unsafe, faulty or misdescribed goods.
11. Our responsibility to you
We are responsible for losses that you suffer as a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where the law requires us to do so.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for losses caused by matters for which we are not legally responsible.
If you use goods for commercial, business or resale purposes rather than primarily as a consumer, different legal rules may apply. Nothing in these Terms is intended to give business customers consumer rights that do not apply by law.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, nothing excludes or limits liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights in relation to goods, including rights relating to goods that are faulty, not as described or not fit for purpose where applicable;
- any other liability that cannot legally be excluded or limited.
12. Events outside our reasonable control
We will not be responsible for delay or failure to perform an obligation where and to the extent that the delay or failure is caused by an event outside our reasonable control.
If such an event significantly affects the performance of your order, we will contact you where reasonably possible and take reasonable steps to minimise the effect. Your statutory rights, including rights relating to delayed or failed delivery, are not affected.

We will do our best to investigate and resolve your complaint promptly. Making a complaint does not affect your statutory rights.
14. Governing law and courts
These Terms and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer, you will retain any mandatory legal protections that apply to you. You may bring proceedings in the courts entitled to hear your claim under applicable consumer law. Nothing in these Terms is intended to restrict any right you have to bring proceedings in a court that the law permits you to use.
15. General terms
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
No person other than you and us has any right to enforce a term of the contract between us, except where the law expressly provides otherwise.
These Terms do not override any description, statement or information about a product that forms part of our contract with you under applicable consumer law.
16. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our business, delivery arrangements or the law.
The version published on the Website at the time you place your order will apply to that order. A later change to these Terms will not retrospectively change an existing contract unless the law permits it and the change is properly agreed.
Model cancellation form
You may use this form if you wish to cancel an online purchase under your statutory cancellation rights, but you do not have to use it.
